Ayu Inc. does not market, sell, reveal, publish or share the collected individual particulars to any third parties with whom Ayu Inc. has no business dealing or contractual relationship. Ayu Inc. only discloses the data or information with trusted parties or affiliate partners for trade/business arrangements. Ayu Inc. has confined the use of identification particulars of our customer's contracts, policies, and contracts.

If you wish to amend, rectify or reevaluate your identification particulars, you may submit a request for the same via Ayu Inc.’s official website www.ayuincusa.com. Ayu Inc.’s representative customer care team will revert back with a suitable response at the earliest.

Ayu Inc. doesn’t share or reveal any personal particulars of Ayu Inc.’s customers for any profits or monetary benefits. Ayu Inc. gives its customers the right to take necessary action in case of any breach of contract or if they find Ayu Inc. selling any personal identification information for the sole intent of earning profits.

Purchase Terms & Conditions

These Purchase Terms and conditions shall apply to all the purchase orders or contracts for the supply of products or services by Ayu Inc. No amendment, modification or change to these terms and conditions shall be implied unless agreed in writing between Ayu Inc. and the buyer.

PRICE & PAYMENT TERMS

The prices, expenses or taxes for the products or services supplied by Ayu Inc. shall be specified in the purchase order or contract.
The prices, expenses or taxes for the products or services purchased via this platform shall not be higher than that mentioned in purchase order or contract.
The buyer shall be accountable for any charges other than those mentioned in the purchase order or contract.
An invoice shall be issued by Ayu Inc., on or after the delivery of products or services, as per the terms set in the purchase order or contract.
The buyer shall make the payment net thirty (30) days from the invoice date.
In case of late payment by the buyer, Ayu Inc. shall be entitled to charge an interest at the rate of……% per annum above the base rate of Ayu Inc.’s bank from the date of overdue until the date of payment.

DELIVERY

The delivery of products or services shall be made in accordance with the quantities and date specified in the purchase order or contract.
The delivery of products or services shall be made at a buyer’s location or any other destination as specified in the purchase order or contract.
If Ayu Inc. identifies that complete delivery may not be made within the specified time or date at buyer’s location or other destination specified in the purchase order or contract, or in the specified manner, Ayu Inc. shall timely notify buyer and suggest another possible date to complete conforming delivery.

WARRANTY

Ayu Inc. warrants the quality of products or services supplied under the contract or purchase order.
Ayu Inc.’s commitment shall extend to any case of defect, deformity or non-conformity arising within the warranty period from delivery of the products or services.
In case of non-conformity, Ayu Inc. shall be liable to repair or replace the defective goods at expenses born by Ayu Inc. or repay the complete price or a part of the price correlating to the defect to the Buyer.

PACKAGING & SHIPMENT

Ayu Inc. shall be responsible to ensure that the products to be supplied to the buyer are packed, marked and prepared to dispatch in suitable containers or other special facilities required, in a manner in accordance with industry standards for the mode of transportation and appropriate security controls to avoid any deformity while in transit.
Ayu Inc. shall be responsible to mention all the necessary instructions for proper handling or loading of products along with legal markings, warnings as imposed by the Department of Transportation, on the product packages or containers.
Ayu Inc. shall provide the invoice and packing list along with each container or shipment.

RISK

The products shall remain at Ayu Inc.’s risk until delivered at buyer’s location or destination.
Ayu Inc. shall be responsible to maintain a contract of insurance over the invoiced products to assign the benefits of such insurance to the Buyer.

INSPECTION OF PRODUCTS & REJECTION

It shall remain the responsibility of the buyer to inspect, test and reject the non-conforming products.
Buyer may return any rejected products to Ayu Inc. at expenses to be borne by Ayu Inc.

LANGUAGE

All communications, and proceedings related to purchase order shall be in English language.

GOVERNING LAWS/JURISDICTION

The terms and conditions mentioned here shall be governed by the laws of the State of ……………………………..
